By accessing or using the AgriReach platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.
These terms apply to all users of AgriReach, including farmers, lenders, financial institutions, cooperatives, and any other parties accessing our services.
2. Description of Service
AgriReach provides an agricultural credit infrastructure platform that includes:
- AgriVerify: Farmer identity verification and registration
- AgriLearn: Agricultural and financial education modules
- AgroCast: Weather and agronomy advisory services
- AgriScore: Credit scoring system for farmers
- AgriConnect: Marketplace connecting farmers with lenders
- AgriWatch: Post-loan monitoring and support
We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.
3. User Accounts and Registration
To access certain features of AgriReach, you must register for an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old to create an account. One account per individual or entity.
4. User Responsibilities
As a user of AgriReach, you agree to:
- Comply with all applicable Nigerian laws and regulations
- Provide truthful information in your profile and applications
- Not engage in fraudulent activity or misrepresentation
- Not attempt to manipulate your AgriScore or system algorithms
- Not use the platform for any illegal or unauthorized purpose
- Not interfere with or disrupt the platform's infrastructure
- Not attempt to gain unauthorized access to any part of the platform
- Respect the intellectual property rights of AgriReach and others
5. AgriScore Terms
The AgriScore is a proprietary credit scoring system. By using AgriScore, you acknowledge and agree that:
- Your AgriScore is calculated based on the data you provide and system algorithms
- AgriScore is a tool to facilitate lending decisions, not a guarantee of credit approval
- Lenders may use your AgriScore as one factor in their lending decisions
- Your score may fluctuate based on your activities, repayment behavior, and other factors
- You can view the factors affecting your score but the complete algorithm is proprietary
- AgriReach does not guarantee loan approval based on your AgriScore
6. Lending and Financial Services
AgriConnect facilitates connections between farmers and lenders. Please understand:
- AgriReach is not a lender and does not provide loans directly
- Any loan agreement is between you and the lending institution
- We do not guarantee the terms, rates, or availability of any loan product
- Users are responsible for reviewing and understanding loan terms before accepting
- Lenders are independent entities responsible for their own regulatory compliance
- We are not liable for any disputes between farmers and lenders
7. Intellectual Property
All content, features, and functionality of AgriReach, including but not limited to text, graphics, logos, icons, software, and algorithms, are the property of AgriReach or its licensors and are protected by Nigerian and international intellectual property laws.
You may not:
- Copy, modify, or distribute our content without written permission
- Use our trademarks, logos, or branding without authorization
- Reverse engineer, decompile, or disassemble our software
- Use automated systems to scrape or extract data from our platform
- Create derivative works based on our proprietary systems
8. Privacy
Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy. By using AgriReach, you consent to the data practices described in the Privacy Policy.
9. Disclaimers and Limitations
Service Availability: AgriReach is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free operation of the platform.
Accuracy: While we strive to maintain accurate information, we do not warrant the completeness, reliability, or accuracy of any information on the platform. Weather forecasts, agricultural advice, and educational content are provided for general guidance only.
Financial Decisions: AgriReach is not a financial advisor. Users should seek independent professional advice before making financial decisions. We are not responsible for any losses resulting from your use of the platform.
Third-Party Links: Our platform may contain links to third-party websites. We are not responsible for the content or practices of these external sites.
10. Limitation of Liability
To the maximum extent permitted by law, AgriReach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or business opportunities
- Service interruptions or technical failures
- Unauthorized access to your account or data
- Decisions made by lenders based on your AgriScore
- Actions or omissions of third-party service providers
Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim, or NGN 10,000, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless AgriReach, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the platform
- Your violation of these Terms
- Your violation of any rights of another party
- Any inaccurate or fraudulent information you provide
12. Termination
We may terminate or suspend your account and access to AgriReach at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination:
- Your right to use the platform ceases immediately
- We may delete your account and associated data
- Outstanding obligations and liabilities survive termination
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of AgriReach shall be subject to the exclusive jurisdiction of Nigerian courts.
